Work Permit in Canada

A simplified entry program to Canada has been launched for Ukrainian citizens and their close relatives.
Work Permit - a work permit to work in Canada that:

allows a person who is not a Canadian citizen or permanent resident to work in Canada.
is required if you want to work in Canada, even if your employer is outside of Canada;
is usually valid only for a specific employer, job and length of time;
issued under an authorization for an employer to hire a foreign employee (LMIA), or under a job offer from an employer who is exempt from this authorization.
Below we will go into detail about each item and describe how to obtain work permits in Canada.
The visa that brings you to Canada is not a work permit, it is a visa that allows you to stay in Canada. A Work Permit is a separate document that is issued when you first cross the border into Canada on a work visa.
Types of work permits

Work permits can be of several types depending on the applicant's situation. They are divided into:

  • Work Permit: a regular work permit that is issued if you have already received a job offer from a Canadian employer and obtained a work visa;
  • Open Work Permit: an open work permit, which is issued in certain cases. It does not require a valid job offer.

Employer Requirements

To go to Canada on a work visa when applying, you need to take into account that for a positive decision not only you as an applicant must meet the requirements, but also the employer.

In particular, he must:

  • provide a valid and genuine invitation to work;
  • have a good track record over the past 6 years of employing foreign workers, namely: comply with the terms and conditions of wages, workplace and work to be performed;
  • comply with all country and provincial laws.
That said, not every business owner will be able to issue an invitation to a foreigner. Canada has a policy that anyone who wants to hire a citizen of another country must prove the need to do so. Namely - to justify why he can not find an employee among his fellow citizens.

This document is called an LMIA, and it means that the employer can hire a foreigner.

Requirements for the applicant

Since Work Permit is issued for a certain period of time, it is important to the immigration service that you do not remain illegal after the end of the contract. This will require you to prove your connection to your home country.

Of course, the standard requirements for applicants also remain in place.

Which means that you:

  • must prove your connection to your current place of residence: real estate, family;
  • not in trouble with the law or a potential danger to Canada;
  • do not plan to work for an employer on the ineligible list;
  • do not plan to work in the erotic, striptease or other related fields;
  • do not have a serious medical condition that requires constant care and medical supervision.

List of documents for a work visa

There are quite a lot of documents for this type of visa, and all of them are very important. The absence of any of them can significantly reduce your chances of getting a visa.

To apply for a visa you will need:

A valid travel document - a passport.
It is necessary to have at least 2 blank pages.

Photo.
For in-person submission (not current now), 2 photos will be required, and for online submission, 1 electronic photo will be required.

Proof of job offer:

  • If the employer is exempt from the LMIA, the job offer number (begins with the letter "A" and is followed by seven digits) must be provided;
  • if the employer has obtained an LMIA, you must provide a copy of that document as well as a copy of the employment contract.
Proof that you are suitable for the job.
For example, a valid certificate from a Canadian province or territorial trade certificate, or educational degrees and certificates, or experience in a similar position.

If you plan to work in Quebec - a copy of a Quebec Certificate of Acceptance (CAQ) from the Ministry of Immigration, Diversification and Social Security (MIDI).
That said, if the employer is exempt from LMIA, you usually don't need the CAQ either.

Marriage Registration Certificate.
If your spouse stays in the home country - this will be a link to current residence. But, if he/she is accompanying you, this document is needed to prove relationship to the accompanying person.
You can also prove a civil relationship by additionally completing IMM Form 5409.

Birth certificates of minor children.
Similar to spouses, children increase the chances by staying in their home country. But when accompanied, the certificates will be required to prove parentage.

Birth certificates of other family members.
Will be required to prove parentage in case they are accompanying you.

Real estate certificates in your home country or country of residence.
These documents will increase your chances as they link you to your home country.

Business ownership documents.
These will help confirm additional financial support for your trip, and will also give you a slightly better chance of being connected to your home country.

Documents proving status in your country of residence.
If you are not currently residing in the country as a citizen, you will need to provide a document confirming your official status.

A bank statement for the last 4 months.
Even though you are traveling for the purpose of working and earning money, you will need to support yourself and accompanying family members at least for the first time.

IMM 1295 and IMM 5645 or IMM 5707.

The exact list of application forms will be given to you by a visa specialist when you apply in person or will be issued by the system after you register in your personal account.
All Canada work visa documents must be translated into English or French if submitted in another language.
Rules for translating documents:

  • the translation must be accurate;
  • it cannot be done by the applicant or any member of the applicant's family;
  • it must be certified by the round seal of the translation company and the signature of the translator;
  • must contain the contact details as well as the name of the person who performed the translation.
Application process and fees

The application process is done online through Canada's official website canada.ca.
Fees must be paid to complete the application process. The cost of the work permit and visa is 155 CAD. Also, for anyone over the age of 14, biometrics will be required. The fee for it is 85 CAD.
After successful payment in 24 hours you will receive a request to submit biometrics. This must be done within 30 days, otherwise the application will be canceled.
Also in most cases (99%) it is required to pass a medical examination, you will receive an additional request for this in your personal cabinet.
The Work Permit itself will be issued to you by a border guard officer when you cross the border. Keep in mind that a visa in your passport does not guarantee you 100% success, so be careful and follow all the instructions of the border guards, they make the final decision.
